Gum entra na Justiça contra o Flu e pedido é de R$ 4,47 milhões
Nesta semana, o ex-zagueiro do Fluminense, Gum, ingressou com uma ação na Justiça do Trabalho do Rio de Janeiro contra o clube a fim de pleitear verbas trabalhistas devidas da época em que defendeu o Tricolor. O valor do pedido é de aproximadamente R$ 4,47 milhões.
A equipe jurídica do atleta alega que houve uso alternativo do direito de imagem de Gum por parte do clube com o objetivo de substituir remuneração de caráter trabalhista. Em outras palavras, a defesa do jogador entende que todos os valores pagos “por fora” devem ser considerados verbas trabalhistas e, dessa forma, incidir nos cálculos de outras verbas, como férias e FGTS, por exemplo.
Além disso, a defesa alega também que durante o período que atuou pelo Fluminense, Gum recebia 60% do valor mensal contratado em direitos de imagem, quando na verdade, segundo os advogados, deveria ser de, no máximo, 40%, de acordo a Lei Pelé.

Por fim, a defesa de Gum argumenta que o atleta não teve sua imagem explorada pelo clube de maneira a se justificar o pagamento da remuneração dividida em salários e direitos de imagem, este, segundo a defesa, em maior parte.
“Se restou “contratada” a exploração da imagem, como objeto deste pacto, porque nunca tal se efetivou? O atleta reclamante jamais teve sua imagem realmente utilizada… Não houve, durante os quatro anos de vigência deste contrato, um único compromisso marcado e confirmado pelo Fluminense, nos termos previstos pelo malsinado instrumento”
Gum jogou pelo Fluminense de 2009 a 2018. Neste período foram dois títulos brasileiros, um carioca e um título da Primeira Liga. Além disso, fez parte do elenco vice-campeão da sul-americana em 2009, bem como do primeiro “Time de Guerreiros”.
